3. Client Responsibilities
Clients are responsible for providing accurate and complete information necessary for service delivery. Clients must respond to requests for information in a timely manner to avoid delays in project timelines.
4. Payment Terms
Payment is due as outlined in your service agreement. Late payments may result in service suspension. All fees are non-refundable unless otherwise specified in your service agreement or our Refund Policy.
5. Intellectual Property
Upon full payment, clients retain ownership of all content created specifically for them. DataDrivenHQ retains the right to display work in portfolios and marketing materials unless otherwise agreed in writing.
6. Confidentiality
Both parties agree to keep confidential any proprietary information shared during the course of the business relationship. This includes business strategies, customer data, and technical information.
7. Limitation of Liability
DataDrivenHQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use of our services. Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.
8. Warranty Disclaimer
Services are provided "as is" without warranties of any kind. We do not guarantee specific rankings, traffic levels, or business outcomes. Digital marketing involves inherent uncertainty and results may vary.
9. Termination
Either party may terminate the service agreement with 30 days written notice. Upon termination, client will receive a final invoice for services rendered. Pre-paid fees for unrendered services will be refunded on a prorated basis.
10. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of California. Any disputes shall be resolved in the courts of San Diego County, California.
11. Changes to Terms
DataDrivenHQ reserves the right to modify these terms at any time. Changes will be effective immediately upon posting. Continued use of our services constitutes acceptance of modified terms.
